These Terms of Service govern your use of the Day Dreams website and your purchase of products or services from Day Dreams.
Throughout these Terms, “Day Dreams,” “we,” “us,” and “our” refer to Day Dreams. “You” and “your” refer to any visitor, customer, client, or user of this website.
By accessing this website, purchasing a product, submitting an inquiry, or otherwise using our services, you agree to these Terms of Service. If you do not agree to these Terms, please do not use the website or purchase our products or services.
1. Online Store Terms
You may use this website only for lawful purposes.
You may not use our products, services, website, photographs, designs, artwork, or other content in violation of applicable laws or the rights of another person.
You are responsible for providing accurate billing, shipping, contact, and account information when placing an order.
We reserve the right to refuse or cancel an order when reasonably necessary, including in cases involving suspected fraud, pricing errors, inventory errors, misuse of the website, or violations of these Terms.
2. Products and Availability
Day Dreams creates and sells apparel, merchandise, creative work, and other products that may be produced in limited quantities.
We make reasonable efforts to display product colors, materials, fit, measurements, and other characteristics accurately. However, colors and appearance may vary depending on your device, screen, production process, garment manufacturer, and other factors.
Product availability is not guaranteed.
Some releases may be produced as limited editions. When a limited-edition size or product sells out, Day Dreams is not obligated to reproduce that item in the same garment, material, color, manufacturing method, or edition.
Future editions may use different garments, manufacturers, materials, fits, weights, or production methods while retaining similar or identical artwork.
3. Pricing
All prices are shown in U.S. dollars unless otherwise stated.
Prices, products, promotions, and availability may change without notice.
We reserve the right to correct pricing or product-information errors. If an error affects an order you have already placed, we may contact you before fulfillment to resolve the issue.
Applicable sales tax and shipping charges are calculated at checkout when required.
4. Payment
Payment is due according to the terms presented at checkout or, for certain creative services, according to the payment terms communicated as part of the project engagement.
Orders are not considered accepted until payment has been successfully authorized and the order has been confirmed.
Day Dreams uses third-party payment processors, including payment services made available through Shopify. We do not directly store complete payment-card information.
5. Preorders
Some products may be offered for preorder before physical inventory is available.
Products identified as preorders are not ready for immediate shipment.
When you place a preorder:
- payment may be collected at checkout;
- your order reserves the selected product and size for the applicable production run;
- production may begin after the preorder period closes; and
- the estimated shipping or fulfillment period will be communicated on the product page or during checkout.
Preorder timelines are estimates and may be affected by garment availability, manufacturing, printing, shipping, production delays, or circumstances outside our reasonable control.
If a significant delay occurs, Day Dreams may provide an updated fulfillment estimate and any cancellation or refund options required by applicable law.
Do not place a preorder if you require delivery before a date that Day Dreams has not expressly guaranteed.
6. Limited Editions
Certain Day Dreams products may be identified as a First Edition, Second Edition, limited run, limited release, or similar designation.
These designations refer to a particular production run and may reflect differences in garment manufacturer, blank, fit, fabric, production method, artwork execution, or other characteristics.
A later edition should not be assumed to be physically identical to an earlier edition.
Once a limited edition is sold out, Day Dreams may choose not to reproduce it in its original form.
7. Shipping
Shipping availability, rates, estimated processing times, and delivery information are described in our Shipping Policy.
Delivery dates are estimates unless expressly guaranteed.
Once a shipment has been transferred to a carrier, delays or delivery issues may occur outside Day Dreams' direct control.
Customers are responsible for providing a complete and accurate shipping address.
Additional terms concerning lost packages, incorrect addresses, international orders, carrier delays, and other shipping matters are contained in our Shipping Policy.
8. Local Meetup
Day Dreams may offer free local meetup for eligible customers in the Jacksonville-area service radius.
When available, this option will appear during checkout.
After purchase, Day Dreams will contact the customer to arrange a mutually convenient public meeting location and time.
Customers should not travel to a proposed meetup location until the details have been confirmed.
Local meetup availability is not guaranteed for every address or order.
9. Returns and Exchanges
Purchases are subject to our Returns & Exchanges Policy.
Unless otherwise required by law, all sales are final except for the exchange or store-credit options expressly provided in that policy.
Customers are responsible for reviewing product descriptions and sizing information before purchasing.
Limited-release, personalized, custom, sale, or otherwise designated final-sale products may not be eligible for exchange or store credit.
10. Product Care
Customers are responsible for following the care instructions provided with or associated with Day Dreams garments.
Damage caused by improper washing, drying, ironing, bleaching, dry cleaning, or other improper care is not considered a manufacturing defect.
11. Creative Services
Day Dreams may offer photography, marketing, merchandise development, Shoot to Shirt, and other creative services.
Submitting an inquiry does not create a client relationship or obligate Day Dreams to accept a project.
Creative engagements may be subject to additional written terms concerning:
- project scope;
- pricing;
- deposits and payment schedules;
- cancellation or rescheduling;
- revisions;
- usage rights;
- intellectual property;
- travel;
- production expenses;
- deadlines; and
- final deliverables.
If separate project terms are provided for a creative engagement, those terms control to the extent they conflict with these general Terms of Service.
12. Intellectual Property
Unless otherwise stated in writing, all content appearing on the Day Dreams website is owned by or licensed to Day Dreams, including:
- photography;
- artwork;
- graphics;
- designs;
- logos;
- campaign concepts;
- text;
- product designs;
- video;
- website content; and
- other creative materials.
You may not reproduce, distribute, sell, modify, publish, commercially exploit, or create derivative works from Day Dreams content without prior written permission.
Purchasing a physical product does not transfer ownership of the underlying artwork, photography, design, trademark, or other intellectual property associated with that product.
Client projects may have separate usage-rights arrangements established in writing.
13. User Submissions and Communications
If you submit ideas, references, photographs, project information, feedback, or other materials to Day Dreams, you represent that you have the right to provide those materials.
You remain responsible for materials you submit.
Submission of information through a contact form, project inquiry, Shoot to Shirt inquiry, email, or other communication does not guarantee that Day Dreams will accept or undertake the proposed project.
14. Third-Party Services and Links
Our website may include links to third-party websites or services.
Day Dreams is not responsible for the content, availability, privacy practices, terms, or conduct of third-party websites.
Certain functionality on this website is provided through third parties, including Shopify, payment processors, shipping carriers, analytics providers, and other service providers.
Your use of those services may also be subject to their respective terms and policies.
15. Accuracy of Information
We make reasonable efforts to keep information on this website accurate and current.
However, occasional errors may occur regarding pricing, descriptions, inventory, availability, sizing, images, shipping information, or other content.
We reserve the right to correct errors, update information, or cancel an affected order when reasonably necessary.
16. Prohibited Uses
You may not use this website:
- for unlawful purposes;
- to violate another person's intellectual-property rights;
- to transmit malicious software or harmful code;
- to attempt unauthorized access to the website or related systems;
- to scrape, reproduce, or commercially exploit our content without authorization;

Day Dreams does not guarantee that the website will always operate without interruption, delay, or error.
Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot legally be excluded.

To the fullest extent permitted by law, Day Dreams will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website, products, or services.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
19. Indemnification
To the extent permitted by law, you agree to indemnify and hold Day Dreams harmless from claims, losses, liabilities, and reasonable expenses arising from your unlawful use of the website, your violation of these Terms, or your infringement of another person's rights.
20. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted or limited to the extent necessary, while the remaining provisions will continue in effect.

Obligations and liabilities incurred before termination remain enforceable where applicable.
